EB-5 Source of Funds: The Documents USCIS Most Often Requests

EB-5 applicants must prove their investment came from lawful sources and trace the complete path of the funds. Employment income, business profits, property sales, gifts and loans can all qualify, each with different evidence.

Why source of funds matters most

When reviewing I-526E petitions, source of funds is the most common reason for requests for evidence. You must show the money was lawfully obtained and explain each step from its source to the project.

Common qualifying sources

  • Employment income: tax returns, salary evidence and bank records
  • Business profits: company financial statements, shareholding evidence and dividend records
  • Property sales: sale contracts, mortgage records and the source of funds used to buy the property
  • Gifts: gift documents plus evidence of the donor’s own source of funds
  • Loans secured on personal assets: the loan agreement and evidence of the secured asset

The funds path

Every transfer must be recorded, from the source account to the project’s escrow account. Cross-border transfers, transfers through third parties and cash deposits all need extra explanation.

EB-5 application process and timing

  1. Assessment and project selection (4–8 weeks): We choose the TEA category and a vetted project based on your place of birth, your children’s ages and your family’s goals.
  2. Source of funds and investment (3–6 months): Prepare the source-of-funds evidence, make the investment and sign the investment documents.
  3. File I-526E (12–24 months): File the investor petition; eligible applicants in the US can file I-485 at the same time. Once approved, the family receives two-year conditional green cards.
  4. I-829 removal of conditions (After two years of conditional residence): Show the investment was sustained and the jobs created, and receive ten-year permanent green cards.
