Verifying the employer, then moving to the US through EB-3 unskilled

Written by Global Immigrate consultants · Reviewed by Oscar Yip, Founder & Managing Director

Summary

Ms Law’s EB-3 Unskilled Worker experience. She wanted the family to move to the US and her child to grow up there.

Background

Ms Law, from Kaohsiung, applied with her husband and one child. She wanted the family to move to the US and her child to grow up there.

Main concern

She worried whether the US employer and the job were reliable.

Our approach

We verified the employer’s background and confirmed the role met the requirements before she accepted, then followed through labour certification, the I-140 and the backlog.

Process and outcome

After about four years, the family received green cards and moved to the US.

Adviser’s comment

Unskilled categories have longer backlogs, so choosing a reliable employer and being honest about timing matter equally.

EB-3 Unskilled Worker application process

  1. Assessment and employer match (Varies): We confirm the employer, role and work location.
  2. Labour certification (PERM) (Per Department of Labor timelines): Prevailing wage determination, recruitment and filing of the labour certification.
  3. File I-140 (Premium processing about 15 working days): Once the labour certification is approved, the employer files the I-140; premium processing is available.
  4. Green card stage (Depends on visa backlog): File I-485 or attend a consular interview when your priority date is current.

FAQ

Why is the backlog longer?

The unskilled category has fewer visas each year and more applicants, so waits are generally longer than for skilled categories; see the monthly Visa Bulletin.

Must I work for the employer after receiving the green card?

You must genuinely intend to take the job when you apply, and take it up after receiving your green card.

Can my children receive green cards too?

Yes. Your spouse and unmarried children under 21 can receive green cards as derivative applicants. In some cases the Child Status Protection Act (CSPA) protects children who are close to 21.
