The basic rules
- Up to five applicants per business
- Each applicant must hold at least 10% of the company’s voting rights
- Applicants and the designated organisation together must hold more than 50% of the voting rights
Why these rules?
They ensure applicants genuinely own and control the business, rather than being nominal shareholders.
Essential persons
Where a business has several applicants, some can be named "essential persons". If an essential person’s application is refused, the other applicants’ applications may also be affected, so the team must be planned carefully.
Our advice
Assign roles and ownership according to each member’s strengths, and set out responsibilities clearly in a shareholders’ agreement.

- A qualifying new business
- A letter of support from a Canadian government-designated incubator
- Language at IELTS 5
- Sufficient settlement funds: CAD 15,263 for a single applicant, CAD 28,362 for a family of four (based on family size)
- A police certificate and medical examination before immigrating
