Short answer: For company dividends or share/equity sales as EB-5 capital, USCIS must see: where the money was lawfully generated → how it reached you → how it moved to project escrow. Missing financials, missing dividend resolutions, missing sale contracts or a broken bank trail are common RFE causes.
What to prepare for dividends
- Company registration and ownership structure
- Recent financials, audits or tax filings (distributable profits)
- Board/shareholder dividend resolutions
- Personal tax or withholding evidence where applicable
- Bank credits of the dividend
- Wires onward to escrow
A verbal “the company is profitable” is not enough. See US EB-5 Investor Immigration.
What to prepare for share/equity sales
- Proof of ownership (register, certificates, investment agreements)
- Sale agreement and price basis
- Buyer payment proof and your receipt trail
- If a company buyback: corporate resolutions and source of buyback funds
- Capital-gains or reporting evidence where applicable
Cross-border deals also need FX, intermediary accounts and compliant conversion explained.
Typical path breaks
| Issue | Risk |
|---|---|
| Large cash deposit then wire out | Hard to prove origin |
| Dividend never hits personal account; company pays escrow direct | Ownership and path unclear |
| Multiple hops with no explanation | Traceability fails |
| Uncertified translations | Adjudication stalls |
Global Immigrate’s recommendation
Build a source-and-path timeline before choosing a filing date. Plan translations and notarization for Hong Kong/Taiwan corporate and tax documents together. Dividends and share sales are usually harder than salary—budget counsel and accountant time. Do not wire to escrow while the path is still unclear.
