EB-3 for the Whole Family: Spouse and Children in 2026

Written by Global Immigrate consultants · Reviewed by Oscar Yip, Founder & Managing Director

Summary

A qualifying spouse and unmarried children under 21 are usually EB-3 derivatives. Who can be included, how CSPA age works, consular vs adjustment differences, and document validity on a long backlog.

Short answer: A qualifying spouse and unmarried children under 21 are usually derivative beneficiaries of an EB-3 principal—they do not each need a separate employer. They share the principal’s priority date, but each person must still clear medical, police certificates and interview/adjustment eligibility. On long backlogs, watch CSPA and document validity closely.

Who can be included?

Relationship Usually derivative? Watch
Lawful spouse Yes Marriage must remain valid through visa issuance / green-card approval
Unmarried child under 21 Yes Age and CSPA math are critical
Married child Usually no Needs a separate path
Parents, siblings No Outside EB-3 derivative scope

See US EB-3.

Why CSPA matters

Children can “age out” while numbers are pending. The Child Status Protection Act (CSPA) can, when conditions are met, lock a lower age—but:

  • It is not automatic in every fact pattern;
  • Calculation ties to priority date, I-140 approval and when numbers become available;
  • Long backlogs (e.g. mainland China Other Workers) need a risk check before you start.

Consular processing vs adjustment in the U.S.

  • Consular: Family members are often scheduled with or next to the principal; each needs civil and police documents.
  • I-485 in the U.S.: Eligible family members may file together or separately; adjustment eligibility and underlying status issues are assessed case by case.

Global Immigrate’s recommendation

  • List every intended beneficiary and date of birth before filing; rough-check CSPA risk.
  • On long waits: plan passport, police-certificate and relationship-document refresh cycles.
  • “Principal’s priority date is current” does not mean every family file is ready or every child is still under age.

FAQ

Q: Must the spouse speak English or work?
A: Immigration law does not uniformly require English or employment for the spouse; workplace communication is separate.

Q: What if a child marries during the wait?
A: A married child usually loses derivative status—plan early.

Q: Do Other Workers and Skilled use different family rules?
A: Derivative rules are the same; the main difference is how long the principal’s backlog lasts.

FAQ

Must the spouse interview at the same time?

Consular cases are often scheduled together or in sequence; follow NVC/post instructions.

Can a child near 21 still be included?

CSPA math is required; long-backlog cases should be assessed before filing—do not assume protection.

Do family members need their own employer?

Qualifying spouses and unmarried minor children usually do not need a separate PERM.
