The three NIW criteria
USCIS assesses three things:
- The work has substantial merit and national importance
- You are well placed to advance it
- Waiving employer sponsorship and labour certification benefits the US overall
Doctors
Doctors can argue their work’s importance through public health, service in underserved areas, clinical research or medical innovation.
Researchers
Citations, patents, research funding and peer-review experience are key evidence of being "well placed to advance" the work. Linking your research to US industrial or policy priorities strengthens the argument.
Education requirement
A master’s degree or higher, or a bachelor’s plus five years’ relevant experience; exceptional ability can also qualify.
Processing
The NIW I-140 can use premium processing, with a decision within 45 working days; the green card stage follows the backlog for your place of birth.

EB-2 NIW application process and timing
- Profile assessment and case strategy (1–2 months): We assess your education and experience and shape the argument for your petition.
- Prepare and file I-140 (2–4 months): Compile the evidence, recommendation letters and a statement of your plans, and file the I-140.
- I-140 decision (Premium processing about 45 working days): With premium processing, NIW petitions are decided within 45 working days; standard processing takes longer.
- Green card stage (Depends on visa backlog): File I-485 or attend a consular interview when your priority date is current.
