What a conditional green card allows
| Area | Rights |
|---|---|
| Residence | Live in any US state |
| Work | Work or start a business freely |
| Education | Children attend public schools as residents |
| Travel | Travel in and out, with the US as your main residence |
During the two years
- Keep the investment in place: the capital must remain at risk.
- Make the US your main residence: long absences can affect your status; apply for a re-entry permit if needed.
- Keep records: residence, tax and travel.
- Prepare I-829: file within the 90 days before the two years end.
What I-829 must show
- The investment was sustained throughout the conditional period
- The project has created, or will within a reasonable time create, the required jobs
- The investor continued to meet the other EB-5 requirements
Once I-829 is filed, the receipt extends your conditional green card, so your status is unaffected.
Family
Your spouse and unmarried children under 21 also hold conditional green cards and file I-829 with you.
Towards citizenship
The two conditional years count towards the five years needed for citizenship.
