EB-5 Job Creation: How Direct, Indirect and Induced Jobs Are Counted

Written by Global Immigrate consultants · Reviewed by Oscar Yip, Founder & Managing Director

Summary

Each EB-5 investor must create 10 full-time US jobs. Regional center projects can count indirect and induced jobs; direct investments count direct employees. The three types, how they’re calculated, what to check and the link to I-829.

The basic requirement

Each EB-5 investor must create at least 10 full-time jobs in the US.

Three types of job

Type Meaning Regional center Direct investment
Direct People employed by the business Counts Counts
Indirect Supply-chain and related jobs Counts Doesn’t count
Induced Jobs from increased spending Counts Doesn’t count

How regional centers calculate jobs

Usually by an independent economist using an economic model; the report sets out the expected jobs.

An example

A project with 100 EB-5 investors must create at least 1,000 jobs. A robust project expects clearly more than 1,000, as a buffer.

What to check

  1. Conservative assumptions
  2. A healthy buffer, not just the minimum
  3. Who wrote the economic report
  4. The mix of construction-period and operating-period jobs

The link to I-829

Job numbers directly affect whether the I-829 succeeds. We require conservative calculations with a healthy buffer.

FAQ

What if a project creates too few jobs?

It can affect the I-829, which is why job calculations must be reviewed.

When must the jobs be created?

Within the conditional period or a reasonable time, under USCIS rules.

Do construction jobs count?

Regional center projects can generally count construction-period indirect and induced jobs through the economic model.
